Unfortunately, we see this situation often and we always ask that drivers contact us before something like this happens. This depends on many factors, so you must discuss this with your attorney. Most civil cases do not require a court appearance by the driver, with your attorney instead appearing in your place. However, some states, some courts and some cases may require an appearance by the driver. We will let you know as soon as possible if your case requires your presence with your attorney.
